Hanson Septic Regulation Analysis
Supplemental Title V Regulations (revised August 29, 2023)
Last reviewed: March 8, 2026
What This Means
Hanson's Supplemental Title V Regulations focus on inspection procedures rather than system design. The supplement does not modify setback distances, groundwater separation, or leaching area requirements โ the state Title 5 baseline governs system design. The local provisions add enhanced inspection rigor: single cesspools automatically fail, systems must be pumped after inspection with records submitted, inspectors must conduct an interior room count, all system components must be physically exposed and photographed, and water meter readings must be attached to inspection reports. A soil evaluation by a licensed S.E. is required if percolation testing predates May 1995 or no record exists at the BOH. These are procedural and inspection-quality requirements, not design constraints.
Gap Comparison
| Provision | Title 5 | Local Rule | Gap |
|---|---|---|---|
Title 5 Setback Distances | 50 ft wetland/surface water; 100 ft private well; 25 ft irrigation well; 10 ft property line; 20 ft foundation | Supplemental regulations do not modify setback distances. State baseline applies. | None |
Enhanced Inspection Requirements | Standard Title 5 inspection per 310 CMR 15.301โ15.304 | Single cesspools automatically fail. Mandatory post-inspection pumping with records. Interior room count required. All components must be exposed and photographed. Water meter readings required. Soil evaluation by licensed S.E. if perc test predates May 1995 or no record on file. | Enhanced procedural rigor โ does not modify system design requirements |
Outlet Filter and Access Requirements | No equivalent mandatory upgrade at inspection under Title 5 | At Title 5 inspection: outlet cover of septic tank must be brought to grade, filter placed on outlet of tank, D-box cover within 6" of grade. Repair permit required ($100). | Triggered upgrade requirement at inspection โ adds cost but improves system access |

Methodology
This analysis compares local Board of Health supplementary rules against the state Title 5 baseline (310 CMR 15.000). Unlike zoning โ where Chapter 150 preempts certain local restrictions โ local Boards of Health are explicitly authorized under M.G.L. c. 111, ยง 31 to adopt standards stricter than Title 5. Exceeding the state baseline is not a legal deficiency. This analysis measures the gap between local and state requirements and assesses practical impact on ADU feasibility. It does not constitute legal advice.
