East Bridgewater Septic Regulation Analysis
East Bridgewater Board of Health Groundwater Protection Regulations (adopted July 17, 2007)
Last reviewed: March 7, 2026
What This Means
East Bridgewater has not adopted a Title 5 supplement. Septic system design for ADU projects follows the state baseline under 310 CMR 15.000 without local modification — no enhanced setbacks, no nitrogen sensitive area designations, no mandatory I/A technology, no local bedroom definition changes. The only local Board of Health overlay is a Zone II aquifer protection regulation (adopted 2007) that restricts hazardous land uses and impervious cover within aquifer recharge areas. The impervious cover limit (15% of lot area or 2,500 sq ft, whichever is greater) is the only provision with direct ADU implications — lots where the existing structure plus ADU footprint plus driveway would push impervious coverage over the threshold require a stormwater recharge system as a condition of BoH approval. East Bridgewater is among the least constrained towns in southeastern Massachusetts for ADU septic compliance.
Gap Comparison
| Provision | Title 5 | Local Rule | Gap |
|---|---|---|---|
Title 5 Setback Distances | 50 ft wetland/surface water; 100 ft private well; 25 ft irrigation well; 10 ft property line; 20 ft foundation | No Title 5 supplement adopted. State baseline applies without modification. | None |
Impervious Cover Limit (Zone II) | No impervious cover limit under Title 5 | Land uses resulting in impervious cover exceeding 15% of lot area or 2,500 sq ft (whichever is greater) are prohibited in Zone II unless a stormwater recharge system is provided that does not degrade groundwater quality. | Site planning constraint for Zone II lots where ADU addition pushes total impervious coverage over threshold |
Soil Removal Restriction Near Groundwater (Zone II) | No equivalent restriction under Title 5 | Removal of soil, loam, sand, gravel, or mineral substances within 4 feet of the historical high groundwater table elevation is prohibited in Zone II. Exceptions: materials removed and re-deposited within 45 days to achieve final grade >4 ft above historical high water; excavations for building foundations or utility installation. | Septic system excavation in shallow groundwater areas within Zone II may require confirmation that work falls within the foundation/utility exception |

Methodology
This analysis compares local Board of Health supplementary rules against the state Title 5 baseline (310 CMR 15.000). Unlike zoning — where Chapter 150 preempts certain local restrictions — local Boards of Health are explicitly authorized under M.G.L. c. 111, § 31 to adopt standards stricter than Title 5. Exceeding the state baseline is not a legal deficiency. This analysis measures the gap between local and state requirements and assesses practical impact on ADU feasibility. It does not constitute legal advice.
