Design Guidelines for Detached ADUs
Needs ReviewNew Bedford, Bristol County
Building & SafetyWhat This Means for Your Project
This provision is in a gray area โ it may be within the town's authority, but could add time or uncertainty to your ADU project depending on how New Bedford interprets it.
State Law
760 CMR 71.05(5) โ towns may impose "reasonable" design standards for detached ADUs but may not use them to effectively prohibit construction.
Local Bylaw
New Bedford imposes optional design guidelines for by-right ADUs (up to 900 sq ft) but makes them mandatory for special permit ADUs (900-1,200 sq ft), including architectural compatibility requirements.
Impact on Your Project
By-right tier design guidelines are advisory and likely consistent. Mandatory guidelines for the special permit tier are permissible since that tier is beyond the state-guaranteed minimum. Grey area if advisory guidelines are applied as de facto requirements.
